BulldozerPay Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the BulldozerPay application and services operated by AFS HOLDINGS SARL (“Company,” “we,” “us,” or “our”).
By using BulldozerPay, you agree to these Terms. If you do not agree, do not use our services.

1. Definitions

• “Merchant”: A business or individual using BulldozerPay to accept payments
• “Customer”: A person making a payment to a Merchant via BulldozerPay
• “Transaction”: Any payment processed through BulldozerPay
• “Terminal”: The mobile device running the BulldozerPay app
• “Settlement Partner”: The financial institution that holds merchant funds and processes payouts

2. Eligibility

To use BulldozerPay as a Merchant, you must:

• Be at least 18 years of age
• Have a valid phone number registered in Cameroon
• Provide accurate business and identity information
• Comply with all applicable laws and regulations

3. Account Registration

LITE Tier:

• Register with phone number and OTP verification
• Access to Mobile Money, QR Code, and Pay Link features
• Monthly volume limit of 500,000 XAF

PRO Tier:

• Complete full KYC verification with our Settlement Partner
• Access to all features including Tap to Pay (cards)
• Unlimited transaction volume
• Faster settlement (T+1)

We reserve the right to refuse registration or terminate accounts at our discretion.

4. Fees and Pricing

• Transaction fees apply to all payments processed
• Fee rates vary by payment method and merchant tier
• Fees are deducted from settlements automatically
• We may update fees with 30 days notice
• Current fee schedules are available upon request.

5. Settlements

• Funds from transactions are settled to your designated account
• Settlement timing depends on your tier (LITE: T+3, PRO: T+1)
• Settlements are processed by our Settlement Partner
• We are not responsible for delays caused by banks or payment networks

6. Prohibited Activities

You may NOT use BulldozerPay to:

• Process fraudulent or unauthorized transactions
• Accept payments for illegal goods or services
• Launder money or finance terrorism
• Violate any applicable laws or regulations
• Process transactions for third parties without authorization
• Reverse-engineer or tamper with the app

Violation may result in immediate account termination and legal action.

7. Chargebacks and Disputes

• You are responsible for customer disputes related to your goods/services
• We may debit your account for chargebacks or fraudulent transactions
• Excessive chargebacks may result in account suspension
• Contact us immediately if you suspect unauthorized activity

8. Intellectual Property

• BulldozerPay, B14400ZER, and associated logos are trademarks of AFS HOLDINGS SARL
• You may not use our branding without written permission
• The app and its contents are protected by copyright

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We provide BulldozerPay “as is” without warranties
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to fees paid by you in the past 12 months
• We are not responsible for third-party services (payment networks, banks, mobile operators)

10. Indemnification

You agree to indemnify and hold harmless AFS HOLDINGS SARL, its officers, employees, and partners from any claims, damages, or expenses arising from:

• Your use of BulldozerPay
• Your violation of these Terms
• Your violation of any law or third-party rights

11. Termination

We may suspend or terminate your account:

• For violation of these Terms
• For suspicious or fraudulent activity
• At our sole discretion with notice
• Immediately for serious violations

Upon termination:

• Pending settlements will be processed within 30 days
• We may withhold funds for potential chargebacks or disputes
• You must cease using BulldozerPay immediately

12. Modifications

We may modify these Terms at any time. Material changes will be communicated via:

• In-app notification
• Email to your registered address
• Notice on our website

Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the Republic of Cameroon. Any disputes shall be resolved in the courts of Douala, Cameroon.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
